Many European nations united last year to propose phasing out the import, use, and production of PFAS, popular as “forever chemicals.” Although the proposed ban is new, regulations have been there for a few years now. For instance, ‘The PFAS Action Act 2019’ was implemented by the EPA in the US to set national drinking water standards and assess PFAS contamination under federal law.
When it comes to PFAS and its safe application in various industries, the US and the EU have been the most proactive. The use of PFAS in liquid and gaseous forms has already been largely phased out. However, when it comes to phasing out solid PFAS, the conversation becomes ambiguous.
Colorado has passed legislation prohibiting the use of PFAS in certain textiles, such as carpets and upholstery. Minnesota and California have banned PFAS in children’s products. Similarly, New York has introduced legislation to prohibit PFAS in cosmetics. The current issue is with solid-form PFAS, which the US is finding difficult to restrict because the industry has not found an alternative.
Earlier this year, the FDA decided to prohibit the use of PFAS in food packaging, and manufacturers agreed to stop using it following a safety assessment. However, the National Resources Defense Council (NRDC) has suggested that PFAS are present in a wide range of products, including water-resistant clothing, furniture, mattresses, and cosmetics, emphasizing the need for broader action against all types of PFAS chemicals.
Following the proposed ban on PFAS, ECHA hosted a webinar in May to discuss proposed EU restrictions on PFAS and to clarify how these regulations could be justified in light of the substances’ persistence and potential health and environmental risks. They also encouraged stakeholders to participate and provide feedback to better understand the ban. However, Germany has recently withdrawn from the proposal due to their critical role in certain industries where no viable alternatives exist, such as medical products, semiconductors, and electrolyzers. A complete ban would disrupt the operations of these industries. France also joined the trend by recently passing a bill to ban products that contain PFAS. The ban will be implemented in January 2026, targeting industries like cosmetics and textiles. By January 2030, the manufacturing and sale of all textiles containing PFAS will be entirely restricted.
APAC is a bit behind and not at all aggressive when it comes to phasing out or restricting the use of PFAS. This is primarily due to the fact that countries such as China and Japan are major semiconductor manufacturers, and PFAS is an important component in the manufacturing process. The phase-out of PFAS could have an impact on their semiconductor export practices to other regions, such as North America and Europe, ultimately affecting their economies.
Recognizing the global push to phase out PFAS, many Asian companies are developing alternatives to ensure safety. Mitsubishi Chemical, for example, developed a plastic material last year that is as fire-resistant as PFAS and is expected to be useful in the production of computer and smartphone parts. DIC Corp. has also created a PFAS-free chemical for semiconductor manufacturing. On the other hand, countries such as India have not expressed strong opinions about the PFAS ban initiative. This is mainly due to the country’s emphasis on economic and industrial development.
Countries around the world should prioritize environmental safety over financial stability when determining whether to ban PFAS. While a balanced strategy involving progressive phase-outs and alternative innovation is required, environmental protection should always come first.
The potential for a complete PFAS ban in the EU makes us wonder whether it is a feasible goal or simply a fantasy. Since so many industries depend on PFAS, the process of moving away from these chemicals will indeed be challenging and gradual. Furthermore, different legislative bodies in various countries have differing views on the PFAS ban, so a unified strategy is currently lacking. The upcoming ECHA review meeting in November will provide clearer insights into the future of the well-known ‘Forever Chemicals’.
